The dean of the Lima Bar Association (CAL), Delia Espinoza, analyzed the Executive Branch’s request for legislative powers and warned that “if the powers are approved, there is a risk of violating human rights. The healthiest thing, Madam President, is to return their bill to them,” she said at the technical session of the Congress Justice and Human Rights Commission.
The dean of the CAL indicated, at the technical session led by Congresswoman Catherin Palomino, that the request for legislative powers for a period of 120 calendar days, in eight areas, lacks “clarity”. Thus, in item 17, regarding the “use of force by the Armed Forces”, it states: “modifies the use of force by the Armed Forces when they intervene in support of the National Police”. “To what extent? Make it harsher? Have them shoot first and ask questions later? Except in dictatorial countries, where yes, the same military personnel and police officers judge the military personnel and police officers who have killed or wounded,” she questioned.
Regarding regulations in the justice and human rights sector, Espinoza Valenzuela also warned that “we are still in the international human rights system and I hope that there is also no intention to propose leaving that system, because none of us would be free. To intend that, through delegated authority, the Executive Branch, whose function it is not, suddenly wants to cut the path and, without realizing it, violate rights”.
In that regard, she urged the bicameral Congress to “hurry up and take the lead on these issues that are so critical, so necessary, so urgent. Because every day there are six deaths; that is the statistic we have, while we are sitting here, people are already being extorted”. She also pointed out that there is no mention either of the repeal of the law that has transferred civil jurisdiction to the military, “it does not say so, and this is worrying”, she stated, concluding with a call for specific dialogue between both branches of the State.
